In this new episode of the #privacyespresso series, Mariano Peruzzotti, partner at our Argentinian law firm member Ojam Bullrich Flanzbaum, sheds light on Argentina’s advances in the #AI sector.

Argentine #DataProtection Authority recently released a groundbreaking resolution on AI, focusing on transparency and personal protection. This resolution analyzes AI use in the national public sector, emphasizing good practices and protection of personal #data. While it sets high-level guidelines, more specific regulations are expected in the future.

Additionally, Argentina has become a formal member of the Council of Europe’s Convention 108, reinforcing its commitment to data protection. The Argentine #DPA also recognized standard contractor clauses for transferring personal data to non-adequate restrictions, providing more options for compliance.

Mariano also shares updates on the ongoing process of reforming Argentina’s data protection regime. The proposed bill, influenced by the EU #GDPR, is a crucial step in modernizing the outdated personal data protection law from the year 2000. The proposed fines, outlined in the 2024 budget bill, could reach up to approximately 28 million US dollars, signaling a significant shift toward stricter compliance measures.
